General terms and conditions Renessence

We are Renessence B.V, part of the Urban Gym Group B.V. (Renessence). Renessence offers wellness treatments, wellness services and studio classes at Renessence in Amsterdam (Renessence). For more information about Renessence and the different Services, visit the website: https://renessence.com (Website).
1. Applicability
1.1 These general terms and conditions (Terms) apply to the legal relationship between Renessence and every natural person or legal entity who obtains Services (the Client)
1.2 Renessence offers Clients a variety of wellness treatments, yoga classes and corresponding wellness services (the Services).
1.3 These Terms also apply to every natural person who uses the Services of Renessence, regardless of whether Membership or any other agreement has been concluded with Renessence. Thus, these Terms apply, inter alia, to Services offered by Renessence, including one-time visits. The Terms will be made available to a Client when registering for a visit.
1.4 Renessence offers Services under the condition that a Client, and any other user of the Services, accepts these Terms.
2. Services
2.1 The Services are available to Clients through either a single purchase (the Visit), in package deals (the Package) or through a subscription membership for Services for a definite period of time (the Membership).
2.2 An up-to-date overview of the various Services and Memberships for these Services is available on the Website.
2.3 Renessence offers non-medical wellness treatments. Clients with relevant medical conditions (including but not limited to cardiovascular conditions, respiratory conditions, high or low blood pressure, diabetes, circulatory disorders, skin sensitivities) must undergo a mandatory consultation with a physician before receiving the non-medical Services provided by Renessence. 3. Reservation and payment for Visits and Packages
3.1 Clients have the option to either walk in for a Visit or book a Visit in advance. For walk-in Visits, payment is made directly at Renessence Front Desk. For pre-booked Visits, the Client can pay at the time of reservation.
3.2 The Visit and the Package can be reserved on the Website.
3.3 Packages must be paid in advance before the Client can make reservations for Services included in the package.
3.4 Client understands that reservations for Visits and Packages are subject to availability. 4. Membership
4.1 Renessence offers different kinds of Memberships with access to different Services. An up-to-date overview of the various Memberships and possible additional Services are available on the Website.
4.2 The Membership starts on the day of registration. Renessence provides the Client of an overview of the Membership upon completion of registration (Registration Confirmation).
4.3 The Membership is personal and non-transferable. The Membership can only be used by the Client that entered into the Membership. The Membership can be frozen on medical grounds, in consultation with Renessence (suspension). Renessence reserves the right to request additional evidence from a Client when requesting a freezing. The period that the Membership is frozen will be added to the originally agreed term. A freeze can last a minimum of one to a maximum of two months.
4.4 Each Client may only book one Visit for a specific Service per day. However, Clients are allowed to book multiple different Services on the same day.5. Cancellation policy
5.1 Clients may cancel or modify a Visit or Package reservation by contacting Renessence through the Website, via the designated online booking system, by email, or by phone.
5.2 Cancellations or modifications made within the specified cancellation period of 12 hours will be subject to the Renessence cancellation policy as outlined on the Website and may include any applicable cancellation fees or penalties.
5.3 Refunds for cancelled Visits or Packages will be processed in accordance with the Renessence refund policy, as stated on the Website or (if applicable) as communicated to the Client in the Registration Confirmation.
5.4 An interim cancellation of a Package does not result in Renessence's obligation to refund the remaining unused but paid amount.
5.5 No-shows or failure to cancel a reservation within the designated timeframe may result in the forfeiture of any fees paid for the Visit or Package.6. Right of Withdrawal
6.1 After conclusion of a Membership the Client has the right to cancel the Membership free of charge up to fourteen (14) days after registration.
6.2 When exercising the right of withdrawal, the Client owes Renessence the pro-rata amount based on the basic rate for the agreed Membership, proportional to the Services or amount of calendar days the Client used during his/her Membership period. 7. Duration and cancellation of the Membership
7.1 Cancellation of the Membership is possible by the end of the agreed term, subject to one month's written notice.
7.2 The Membership will automatically be converted into a Membership for an indefinite period of time, after the end of the agreed term.
7.3 In addition to the Clauses 7.1 and 7.2, a Client can cancel the Membership or any cancellable Service at Renessence.
7.44 An interim cancellation of a Membership or Package does not result in Renessence's obligation to refund the remaining unused but paid amount.
7.5 Renessence reserves the right to terminate a Membership without giving reasons and without refund of Membership Fees in the following cases:
a) Without prior warning, if a Client seriously and/or repeatedly violates the regulations set by Renessence and/or Renessence House Rules and/or there is any other reason that maintaining the Membership can no longer reasonably be expected from Renessence;
b) After prior written warning, if payments arising from the Membership are not made thirty (30) days after the payment due date, the payment obligation does not expire; or
c) After prior written warning, if a Client fails to comply with these Terms.8. Membership Fees
8.1 The Membership is entered at the rates set out in the Registration Confirmation (the Membership Fees). The current Membership Fees are also available on the Website.
8.2 When a Membership expires and is automatically renewed, the monthly Membership Fee will be calculated based on the initial Membership Fees for the initial term of the Membership.
8.3 Renessence reserves the right to adjust the Membership Fees. Any increases in the Membership Fees will be announced thirty (30) days prior to the increase via an e-mail to the e-mail address provided by the Client. If there is an increase in the Membership Fees as applicable to Client, the Client has the right to terminate the Membership free of charge until the date the price increase comes into effect.
8.4 Renessence reserves the right to index the Membership Fees annually using the Consumer Price Index (CPI) from Statistics Netherlands (CBS). The termination option as included in Article 8.3 does not apply in the event of an indexation of the Membership Fees by Renessence on the basis of the CPI.
8.5 Payment of Membership Fees and additional services is made in advance for the whole Membership. The payment can be made in Renessence via Debitcard and Creditcard or Client has the option to request payment via an invoice, if the Membership Fees amount to more than EUR 1.000. Any invoice issued by Renessence has a payment term of 30 calendar days. Renessence will charge the Creditcard on file monthly after renewal, therefore registering the Creditcard details is necessary.
9. Registrations
9.1 In order to provide optimal and secure Services, all Client visits are registered in the Renessence booking system.
9.2 Each guest must book individually when undergoing an individual treatment (Cryotherapy, Ice Bath, Oxygen Hydroxy)
10. Instructions
10.1. Client acknowledges that Renessence uses highly sophisticated and technical equipment in providing the Services. Client also acknowledges that the improper use of this equipment may be harmful to the body and health of Client and third parties.
10.2. Clients are required to follow all instructions and safety guidelines provided by the Renessence staff, therapists, instructors, or as included in the Renessence House Rules (Renessence House Rules).
10.3. Given the above, Client must follow and ensure all instructions of the Renessence staff at all times. In addition, client must adhere at all times to the Renessence House Rules and any additional rules and requirements mandated when using the equipment. The Renessence House Rules are available at Renessence and on the Website.11. Liability
11.1. Client uses Renessence's Services at their own responsibility and risk.
11.2. Client remains personally responsible for their own behaviour within the facilities of Renessence. Renessence is not liable for the conduct of a Client and any resulting damages.
11.3. Renessence is not liable for any personal injury, accident or death of a Client during their stay in and around Renessence, regardless of whether the provided facilities and Services are used, except in the event of wilful intent or gross negligence by Renessence.
11.4. Client indemnifies Renessence against any liability to third parties for damages suffered by the third party in question during his or her attendance at the Renessence as a result of acts or omissions by a Client.
11.5. Renessence is not liable for damage to or loss of property, as well as thefts of property in the facilities of Renessence.
11.6. If Renessence can in any event in any way be held liable for Client's damages, Renessence's liability is limited to the amount paid out by the insurer of Renessence in that specific case.
11.7. Nothing in these Terms shall exclude or limit Renessence's liability where it cannot be excluded or limited under applicable law, such as in the event of wilful intent or gross negligence by Renessence.12. Conforming conditions
12.1. By using the Services, the Client declares that it accepts these Terms. In addition, by using the Services, the Client declares that it has read the Renessence House Rules and other regulations established by Renessence. 13. Other provisions
13.1 Unilateral changes to these Terms by Renessence will be communicated to the Client via e-mail two months before they take effect. The Client has the option to cancel its Package or Membership free of charge in the event of substantial changes to these Terms, subject to a notice period of at least one month by the date on which the new Terms come into force.
13.2. Client can submit any complaints directly to the manager of Renessence or via welcome@renessence.com.
13.3. If any provision of these Terms is held to be unlawful, void, voidable or otherwise unenforceable, this shall not affect the validity and enforceability of the remaining provisions of these Terms. The unlawful, void, voidable or otherwise unenforceable part shall be (deemed to be) replaced by a valid and enforceable provision that comes as close as possible to the purpose and scope of the replaced provision.14. Privacy
14.1 Renessence considers the protection of personal data to be important. Renessence acts in accordance with the General Data Protection Regulation (GDPR).

15.1 These Terms and all other agreements between Renessence and Client are governed exclusively by Dutch law.
15.2. If Renessence and a Client cannot resolve a dispute between themselves, disputes between the Client and Renessence shall be submitted to the competent court of the District Court of Amsterdam.16. Questions, comments and suggestions
